Last Sunday my boyfriend and I decided to have a romantic evening at hotel. When I arrived I checked in alone and proceeded to my ground floor room. Upon entering the room I noticed that the window was wide open although it was pretty chilly and windy. I closed it and thought nothing more of it as I pulled the curtains closed. Later that evening as we were being intimate, I glanced at the window and noticed that although I had pulled them closed there was a small open space where they overlapped. I then noticed what at first appeared to be a shadow but was really a man wearing a dark shirt and tan pants. I told my boyfriend who immediatly jumped out of bed and pulled the curtain back to see a dark haired man with dark shirt and tan pants. When we went to the front desk to talk to the manager it was the same guy. I asked for a refund and he refused so we called the cops. The cops informed me that there is no peeping tom ordinance in our town. I got my money back but can I still sue?Can I sue the hotel manager for watching me and my boyfriend have sex through a small opening in the curtains?
Since there's no ordinance prohibiting this in your town, unfortunately, you probably can't take him to court unless you have something he can be charged with. The only thing I can think of that you might be able to charge him with is indecent exposure - IF his pants were unzipped and he was touching himself. The best thing to do would be to call a lawyer who offers free initial consultations. Then they can tell you what your options are, if any.
Was this hotel privately owned by the man in question? If not, I would definitely contact a higher-up, inform them of the incident, and demand they take action against him so that he doesn't invade anyone else's privacy. Can I sue the hotel manager for watching me and my boyfriend have sex through a small opening in the curtains?
No, Because if there is a no peeping tom ordinance there is no grounds for a law suit. It is your responsibility to make sure that there is no way to be seen. It is not against to law obviously in your town for him to be looking through the window.
sounds a bit far fetched to me why would he do this ?i think your just trying to make a quick buck.
Make sure he didn't tape you two or before you know it, I could see you two all over the internet.
I guess you can. I guess the manager must have been bored or desperate.
Be careful, he might say you left the curtain open on purpose, sounds crazy but he will try any excuse.
im pretty sure you shoule be able to... but dont take my word for it... sorry for your misfortune
